To Whom It May Concern, As required by the standards applicable to financial audits contained in Government Auditing Standards, issued by the Comptroller General of the United States and Title 2 U.S. Code of Federal Regulations (CFR) Part 200, Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards (Uniform Guidance), we have provided below our response and corrective action plan addressing the finding in the Report of Independent Auditors on Compliance for the Major Federal Program and Report on Internal Control Over Compliance Required by the Uniform Guidance for the year ended September 30, 2023. Response and Corrective Action Plan Finding 2023-001: Department of Housing and Urban Development - Continuum of Care Program -Assistance Listing No. 14.267; Grant period: Year Ended December 31, 2023. Cause: Management did not obtain rate quotations from an adequate number of vendors, and did not retain sufficient documentation nor perform a formal assessment to proceed with the contracted services. Management Response: The Marjaree Mason Center (MMC) did not maintain proper records of the procurement process for two vendors associated with janitorial services and the client statistical database. MMC has formally started a new procurement policy for all vendors where the vendors will have their own procurement documents. The chosen vendors can be MMC's selected vendor from 1 - 3 years depending on the type of service. All quotes and bids will be maintained on MMC's server.

Corrective Action: There were (2) errors discovered during the procedures that were inaccurate budget calculations in NC Fast. The values entered in NC Fast evidence and used in the eligibility determination did not match the supporting documents or was lacking any substantiating documents. No eligibility errors were found. New Trainings, procedures, and controls are being developed for all Medicaid caseworkers to follow. Applications and Recertifications will continue to be reviewed by Supervisor and Lead Worker. NC Fast Learning Gateway Refresher trainings and new employee trainings: MAGI: Income Determination and Medicaid Ages, Blind, and Disabled (ABD) Income Computation. Manual Budgets and NC Fast Budgets must be used and reviewed to ensure both budgets match. All income must be verified if terminated income and not showing in NC Fast. Income also must be documented in NC Fast of the verification used for calculation of income. Corrective Action Plans will be continued for all workers who are found with trending errors on quarterly 2nd Party Review Spreadsheet. Proposed Completion Date: June 30, 2024 Proposed Completion Date. Certain controls are currently being created and reviewed. Management will continue to monitor the progress of this issue and modify the controls as needed.

FINDING 2023-003 – CONTROLS AND NONCOMPLIANCE OVER SPECIAL TESTS AND PROVISIONS – RETURN OF FUNDS Management’s Response The College accepts this finding and has implemented the corrective plan below to reinforce established policies and procedures to ensure file documentation would identify students in the return funds population. Plan South Suburban College has already established a control process to assist with remaining in compliance as stated in the Single Audit Report Finding 2023-003 Recommendation section. Previously, South Suburban College Financial Aid Department used Business Objects reports to retrieve the college Return of Title IV funding (R2T4) population, it was found that the reporting process was insufficient, therefore the Director of Financial Aid decided to develop an R2T4 tracking process to maintain accurate return of funds calculations. The R2T4 student tracking process is reviewed by the Financial Aid Coordinator and verified by the Financial Aid Manager every week. The Director of Financial Aid will continue to work with South Suburban College Information Technology Department to enhance the retrieval of the Return of Title IV funding student populations reporting process through Ellucian Colleague per 34 CFR 668.22(a)(1) through (a)(5). *This corrective plan has been implemented. FINDING 2023-001 – CONTROLS AND NONCOMPLIANCE OVER-REPORTING – PELL COMMON ORIGINATION AND DISBURSEMENT Management’s Response The College accepts this finding and has implemented the corrective plan below to reinforce established policies and procedures regarding timely submission of COD information. Plan South Suburban College Financial Aid Department has implemented cross-training between the Financial Aid Manager, Financial Aid Coordinator, and Financial Aid Advisor to reinforce in the case of possible turnover the established controls for processing Pell Common Origination and Disbursement payments within the 15 days of submission window per the required Uniform Guidance in the Compliance Supplement. For instance, the control will consist of one of the designated staff members listed to process the batches weekly. This will allow all batches to be processed within 7 days assuring that the 15-day submission period is within compliance. In addition, the Director of Financial Aid has added a weekly calendar reminder for all trained staff to avoid missing batch processes due to personnel being out of the office or working from home. This control process was executed after positions were successfully filled and staff trained, in the Fall 2022 term. We have already adjusted the enrollment reporting program to properly report students who are enrolled at a ¾-time (“Q”) level. We will also work with the National Student Clearinghouse to ensure the enrollment effective dates are correctly reported for both the campus and program levels. Federal Award Findings and Questioned Costs Finding: 2023- 001 Eligibility Errors: No eligibility errors were found. Internal Control Errors: 1. Failure to comply with policy requirement: Two (2) instances of failure to complete at least one compliance component. The work number was not run for all individuals of age with the potential for earned income in one case. 2. Inaccurate Resource Calculation: One (1) instance of inaccurate resource calculations in NC FAST. The values entered in NC FAST evidence and used in the eligibility determination did not match the supporting documentation or was lacking any substantiating documentation. NCF has added functionality that automatically runs TWN at MAGI application and most MAGI recertification times. This will help ensure TWN is always completed on all eligible aged persons in the HH. For Non-MAGI programs, documentation that TWN was completed manually has been added to our Adult Medicaid review document. We have also had training on when TWN must be completed outside of NCF when a system error may be returned. 2. Camden County has implemented an Adult Medicaid review document that summarizes all elements of eligibility to allow easy comparison with NCF to make sure all amounts agree. We have completed training with workers regarding review of eligibility decisions to make sure all elements match. Proposed Completion Date: All above actions have been completed as of November 2, 2023. Questioned Costs: The technical errors did not affect eligibility resulting in no questioned costs.

However, the District did not have the authorization or resources to perform sampling during the audit period. As a result, the corrective action plan (CAP) was only partially implemented during fiscal year 2023. In fall 2023, the District secured the human resources and required authorizations to conduct random sampling of the faculty data entry. The District’s Internal Audit Department (IAD) is performing random sampling of all campuses. As of fall 2023, all corrective actions have been fully implemented. Explanation of disagreement with audit finding: There is no disagreement with the audit finding. Action taken in response to finding: ECECD recognizes that ECECD did not fully comply with the IDEA part C grant award related to charging rent, occupancy, or space maintenance costs as direct costs prior to receiving approval from the US Education Department in the grant award letter. To correct this compliance oversight, ECECD has substituted funds from General Fund to cover the amount charged to the ECECDFIT2301 to replace the funds that ECECD inappropriately spends on rent, occupancy, and space maintenance. Additionally, ECECD will not charge these costs to this grant prior to receiving written approval in our grant award letter from the US Education Department. Additionally, the Chief Financial Officer (CFO) review, amend and enhance our process to ensure strict compliance with all grant requirements including those in the compliance supplement of 34 CFR Section 303.225(c)(3). 2023-004 Period of Performance U.S. Department of Education Special Education - Grants for Infants and Families Assistance Listing Numbers: 84.181A Recommendation: We recommend the program thoroughly review the dates on vouchers to ensure the activity is recorded to the right grant award based on the period of performance. Explanation of disagreement with audit finding: There is no disagreement with the audit finding. Action taken in response to finding: ECECD takes this matter seriously and as of September 2023, has taken immediate corrective action to address and rectify it. Upon identification of this compliance discrepancy, ECECD reviewed its internal processes and procedures to ensure that costs are appropriately incurred only within the specified period of performance. To prevent any further occurrences of costs being incurred outside the approved period, ECECD has enhanced our oversight mechanisms, implemented additional checks, and reinforced the importance of adhering to the stipulated timeframes within our organization. The cross-training and second review on all invoices has been implemented by the lead financial coordinator. ECECD also established a tracking log to ensure invoices are received and processed within the period of performance. Furthermore, ECECD began conducting a comprehensive review of all incurred costs after the period of performance to identify and rectify any discrepancies. Any such costs that were found to be in violation of federal compliance requirements have been addressed, corrected, and reported as necessary. To prevent any future lapses in reporting, the agency contract program manager will work collaboratively with ASD to develop a system to ensure all costs are incurred timely in the period of performance. This proactive measure will help us maintain transparency and accuracy in our reporting. ECECD is fully committed to strengthening our processes to ensure full compliance with reporting requirements moving forward. The finding is numbered consistently with the number assigned in the schedule. FINDINGS RELATED TO INTERNAL CONTROL OVER COMPLIANCE AND SCHEDULE OF EXPENDITURES OF FEDERAL AWARDS REQUIRED BY THE UNIFORM GUIDANCE 2023-001 – Material weakness related to sliding fee discount application Recommendation: The auditor recommends that procedures and policies surrounding sliding fee discounts are reviewed and revised in order to strengthen internal controls to help ensure calculations and applications of sliding fee discounts are done correctly. In addition, the auditor recommends that all system settings surrounding sliding fee discounts are reviewed to make sure calculations are correctly performed. Planned Corrective Action: Management concurs with the recommendation. Policies and procedures regarding sliding fees will be reviewed and modified as necessary. Finding 2023-002: Federal Agency: U.S. Department of Housing and Urban Development Federal Program Titles: Section 8 Housing Choice Voucher Federal Assistance Listing Number: 14.871 Noncompliance – N. Special Tests and Provisions – Housing Quality Standards Non Compliance Material to the Financial Statements: No Significant deficiency in Internal Control over Compliance for Special Tests and Provisions Criteria: Housing Quality Standards Inspections. The PHA must inspect the unit leased to a family at least annually to determine if the unit meets the Housing Quality Standards (HQS) and the PHA must conduct quality control re-inspections. The PHA must prepare a unit inspection report (24 CFR sections 982.158(d) and 982.405(b)). For units that fail inspection the PHA must correct all life threatening HQS deficiencies within 24 hours and all other deficiencies within 30 days. Condition: Based upon inspection of the Authority’s files and on discussions with management, the Authority did not properly abate three (3) out of ten (10) annual failed inspections selected for testing. Context: The Authority did not properly abate three (3) out of ten (10) failed inspections selected for testing. As a result, the Authority was not in compliance with the HQS as required by 24 CFR sections 982.158(d) and 982.405(b). Known Questioned Costs: $942 Cause: There is a significant deficiency in internal controls over compliance for the special tests and provisions type of compliance related to HQS inspections. The Authority has not properly considered, designed, implemented, maintained and monitored a system of internal controls that assures the program is in compliance. Effect: The Section 8 Housing Choice Vouchers Program is in non-compliance with the special tests and provisions type of compliance related to HQS inspections. Recommendation: We recommend the Authority design and implement internal control procedures that will assure compliance with the Uniform Guidance and the compliance supplement. Authority Response: The Authority has recognized the deficiencies in the Section 8 Housing Choice Vouchers Program and will implement internal control procedures that will ensure compliance with federal regulations. Sarah Parker, Executive Director, was designated to be responsible for implementing this corrective action by March 31, 2024.

Special Tests and Provisions – Housing Quality Standards Inspections Non Compliance Material to the Financial Statements: Yes Material Weakness in Internal Control over Compliance for Special Tests and Provisions Criteria: Tenant Files. The PHA must do the following: As a condition of admission or continued occupancy, require the tenant and other family member to provide necessary information, documentation, and releases for the PHA to verify income eligibility (24 CFR sections 5.230, 5.609, and 982.516). These files are required to be maintained and available for examination at the time of audit. Condition: Based upon inspection of the Authority’s files and on discussion with management there were documents that were unavailable for examination at the time of audit. Context: Of a sample size of sixteen (16) units, two (2) units did not have an annual HQS inspection performed. Our sample size is statistically valid. Known Questioned Costs: $8,640 Cause: There is a material weakness in internal controls over the compliance for the eligibility type of compliance related to the maintenance of tenant files. The Authority has not properly considered, designed, implemented, maintained and monitored a system of internal controls that assures the program is in compliance. Effect: The Section 8 Housing Choice Vouchers Program is in material non-compliance with the eligibility type of compliance related to the maintenance of tenant files. Recommendation: We recommend the Authority design and implement internal control procedures that will reasonably assure compliance with the Uniform Guidance and the compliance supplement. Authority Response: The Authority has recognized the material weakness in the Section 8 Housing Choice Vouchers Program and will implement internal control procedures that will ensure compliance with federal regulations. Sarah Parker, Executive Director, was designated to be responsible for implementing this corrective action by March 31, 2024.

Recommendation Test work on samples from both Portales and Roswell populations resulted in the identification of two possible issues related to incorrect calculations of aid to be returned to federal aid programs based on student’s complete withdrawal from the University. Contact was made with Ellucian/Banner customer support regarding the issue. Ellucian customer care subsequently verified a known issue within vendor software where the R2T4 calculation is incorrect when manual award adjustments or ‘locks’ are made to students who were not enrolled as full-time students when originally disbursed.   Management Response Corrective Action: In an immediate review of all students subject to return of funds calculations in both Banner instances for the 2022-2023 award year it was found that of the 322 (213 Portales/Ruidoso, 101 Roswell) students subject to Return of Title IV Funds, 17 students were identified where the calculation was incorrect, manual recalculation of funding is ongoing and will be handled within allowable timeframes with the business office. Although the software defect is present in both instances of banner no students at the Roswell campus were impacted as a result of procedural differences. Timeline of Corrective Action: Effective immediately the institution has implemented the recommended software vendor “work around”. In addition, all students enrolled less than full time will be monitored and calculations confirmed to ensure calculations are accurate. Recommendation We recommend that follow-up be performed for students who have signed on to the program but have not participated, and that these contact attempts be documented to demonstrate due diligence. Management Response Corrective Action: Management agrees that the corrective action proposed last year was not followed. The GEAR UP Records Manager position was vacant from August 2022 through February 2023 and, as a result, data input was at a minimum. When we began capturing data in November 2022, we fell behind in our data input and we started working with our software representatives (CoBro) to understand and manage our data. In February 2023, we filled our records manager position and that person has received initial and ongoing training. We are now able to understand how to capture and analyze our student data. To effectively track the services we provide, we employ a combination of methods. We utilize advanced data management systems to track the provision of services. These systems include student profiles, service logs, and attendance records, enabling us to monitor who is receiving services and when. We must generate regular reports that detail the distribution of services across our student population. These reports will help us identify and record students who do not utilize services provided by GEAR UP. To capture students who are not benefiting from our services, we will conduct thorough monthly data analysis to identify students who are not accessing services, which may be due to underutilization, lack of awareness, or other barriers. Identifying these gaps will be a primary focus. We will attempt to compare a month-to-month list of students to identify those who have not received services. After we compile a list of non-serviced students, we will make every effort to contact the students by improving communication channels with students, parents, and relevant stakeholders to raise awareness of the available services and events. This includes clear and accessible information about the services, benefits, and how to access them. Timeline of Corrective Action: The in-depth review of student participation began during the latter part of August 2023. This data will be reviewed on a monthly basis indefinitely, to ensure the participation of our students.
