Since 50% was allocated as student emergency grants, expenditures were reported under the student emergency grants section (84.425E) incorrectly. Per recommendations, the University will amend the June 30, 2022, report and will ensure that these expenditures are not reported under section 84.425E of future HEERF quarterly and annual reports. This amendment will be processed no later than March 15, 2023. Additionally, campus will review all previous reports and amend as necessary with a target completion date in April 2023. 2022-001 Economic Injury Disaster Loan ? Assistance Listing No. 59.008 Recommendation: The School should implement procedures to ensure that the records are maintained for sufficient audit trail that the School is in compliance with the terms of the loan agreements. Explanation of disagreement with audit finding: There is no disagreement with the audit finding. Action taken in response to finding: Obtained proper proof of Board approval of the receipt of loan. Though not formally documented previously, the Board of Trustees was fully aware and in agreement with obtaining the SBA loan for emergency relief for the school's operations at the time the loan agreement was signed. The School sent to the SBA proof of hazard insurance in March 2023. Though no proof was provided to the SBA previously and within the required timeline, the proper insurance was maintained and remained active during the required period per the agreement. Updates to obtaining loan contracts process includes a review of the agreement by Operations Manager, Outside Accounting Firm, Head of School, and Board Chair prior to signing. The School sent to the SBA financial reports in March 2023. Upon review, an action plan will be put in place to ensure that all requirements of the agreement are met timely. Additionally, we recommend training for staff to ensure consistency in allowable cost calculations and the review process. Management's Response: Management is in agreement with this finding. The internal checklists and cost reimbursement calculations will be reviewed for accuracy and consistency in the event that such funding is received in the future.

Finding 2022-002: HEERF II Report Not Published Timely a. Comments on Finding and Each Recommendation The University agrees with this finding. Due in part to turnover in the Financial Accounting Services Department, communications regarding reporting requirements for the student portion of the Higher Education Emergency Relief Funds were not reviewed in a timely manner and public reports were not posted timely. Action(s) Taken or Planned on the Finding The University implemented an internal control whereby the Financial Accounting Services Office posts the public reporting as prescribed by the sponsoring agency. Following a review by the Assistant Controller, the Controller will confirm the posted information is documented as prescribed by the sponsoring agency. This internal control was implemented for the March 31, 2022 quarter public reporting period and completed by April 10, 2022. Past reports were uploaded to the webpage for public reporting. Additionally, the University updated our Department of Education contacts to include the Controller and CFO to prevent future turnover from contributing to noncompliance. Finding 2022-001: Student Notifications a. Comments on Finding and Each Recommendation The University agrees with this finding. Due to turnover in the Student Financial Aid Office algorithms producing automated e-mails were not reviewed and were assumed to work in perpetuity. Action(s) Taken or Planned on the Finding The University has reviewed the Federal notification requirements. The Student Financial Aid office and Campus Technology have met and reviewed the algorithms for notifications and updated the parameters. Additionally, the Student Financial Aid e-mail box has been copied on these notifications and will be reviewed. The timeframe for completion of this process will commence immediately with an anticipated completion date of September 1, 2023, and will continue on an ongoing basis as required by new policy directives from oversight agencies. Corrective Action Plan for Finding 2022-001 We are in receipt of the ?Findings Required to be Reported? by Uniform Guidance, regarding reporting. Management agrees with the finding and will perform a detailed review of the reporting requirements in accordance with the final guidelines set by HRSA and will contact HRSA to see if Hendrick can correct patient service revenue by financial class for quarters reported to accurately state net patient service revenue by financial class. As deemed necessary, Hendrick will modify policies and procedures over federal grant reporting. Management has completed an analysis and determined that while the net patient service revenue by financial class was improperly allocated, the calculated lost revenue that Hendrick reported still exceeds the Provider Relief Funding received. Further, the information submitted for Period 2 was the exact same information submitted and audited for Period 1, which did not have any findings during the August 31, 2021 single audit. Jeremy Walker, CFO, is responsible to oversee and implement the corrective action plan.

Section III - Federal Awards Findings and Questioned Costs Compliance Requirement - Procurement, Suspension and Debarment Significant Deficiency in internal control over compliance and compliance Condition: As part of compiling the Commission's population for procurements, from which a procurement sample would be selected, the Commission identified $26,432 of expenditures charged to the grant that were erroneously included in the SEFA, as the procurement methods were not eligible for federal expenditures. As a result, prior to testing compliance related to procurement, the Commission reclassified the $26,432 of expenditures from the federal grant and removed from the SEFA as of June 30,2022. Cause: The Commission's procedures did not allow for timely identification of the expenditures prior to including on the SEFA (and claiming reimbursement). Effect: A journal entry was posted to correct current year federal revenue balance as of June 30, 2022 in the amount of $26,432. Further, the Commission has applied these expenditures to future draw downs in order to reverse the expenditures that were claimed. Recommendation: We recommend that the Commission review its closing policies and procedures as well as its federal grant management procedures to ensure procurement methods are considered prior to claiming expenditures or reporting on the SEFA. Commission Response: Staff concurs with the recommendation and has reviewed and discussed procedures with finance and transit staff. The invoices are coded for expense and funding by project managers. The reimbursement of expenditures is requested based on this information. During this time period there was a shortage of staff both in the finance and transit departments. Funding requirements were reviewed with transit staff. Finance staff will strengthen the invoice process to verify project manager coding against invoicing to prevent and if necessary, timely correct funding errors. Project Managers will be responsible for reviewing monthly project manager reports that include expenditures and associated funding reimbursed.

Deficiency SA-2022-1 a. Significant Deficiency- SA-2022-1 The auditor noted the bi-annual certifications were not performed for the year-end audit for 84.027 Special Education Program. The auditor's recommendation is that the District perform the bi-annual certifications for the federal program. See the below screen shot detail from the audit report. b. The district completed the certifications before field work ending however in the future the District will have the bi-annual certifications completed prior to audit field starting. c. The certifications will be completed on a bi-annual basis in future years.

USDA Community Facilities Loan Reserve Accounts Planned Corrective Action: The College agrees there was confusion around the USDA reserves following a refinance. The College had established reserve minimums but the appropriateness of the amounts needed for reserve appear to have been unclear. There is still disagreement around the amount needed for reserve. The College is presently working with the USDA to clarify the ambiguity and will set reserves accordingly. The USDA has stated verbal agreement that the West Town reserves should be eliminated and replaced with a reserve for North Avenue Capital. The USDA has further agreed verbally that the reserves could have been moved from Morgan Stanley to Ameris Bank as Morgan Stanley was the holder at the time and was named for convenience of Newberry College. The specific institution was not meant to be a condition of the loan, just identifying the existence of the reserve. The College is presently in conversations with the USDA to come back in writing to confirm the approximately $1.4 Million in total direct and indirect USDA loan reserves held at present at Ameris Bank.
