Finding #2022-001- Segregation of Duties (Prior Year Finding #2021-001) Condition: A properly designed system of internal control includes adequate staffing, policies, and procedures to properly segregate duties. This includes systems that are designed to limit access or control of any one individual to your government?s assets, and to achieve a higher likelihood that errors or irregularities in your processes would be discovered by your staff. There are key controls related to significant transaction cycles that are important in reducing the risk of errors or irregularities. At this time, the District does not have the following controls in place: -Persons processing accounts payable are not always separate from those ordering or receiving goods or services. -Persons initiating electronic fund transfers are not separate from those authorizing, confirming, or reconciling the transactions. -There are no procedures in place for review and approval of new vendors. -Persons preparing the payroll also maintain employee records, change employee rates, and change data in the payroll system. -The person reviewing free and reduced food service eligibility can also modify information entered into the system to determine eligibility. -Account reconciliations are not performed by someone independent of the processing of transactions in the account. Effect: Errors or intentional fraud could occur and not be detected timely by other employees in the normal course of their responsibilities as a result of the lack of segregation of duties. Cause: Limited number of personnel. Criteria: Segregation of duties is an aspect of internal control intended to prevent or decrease opportunities of intentional and unintentional errors and fraud. Duties and responsibilities are properly segregated if no single individual either has control over all phases of a transaction or has the ability to both make and conceal an error, whether such error is intentional or unintentional. Recommendation: We recommend that the District consider the benefits of implementing additional policies and procedures to address key controls related to its significant transaction cycles as noted. Response: We agree with this finding but do not believe it is cost effective to increase the office staff in an attempt to bring about a more effective segregation of duties. The Building Principals and the Business Manager approve purchase orders and the Business Manager approves monthly accounts payable checks. Also, the Building Principals or department supervisors approve payroll timesheets prior to processing payroll. The payroll along with the time sheets are then approved by the Business Manager. Action Taken: Compliance Department is now monitoring and tracking PRAC contract renewals for properties. Planned corrective action: We will implement action plans of retraining of Vincentian food pantry volunteers at the two food pantries that were missing application forms by March 31, 2023. The single audit requirements will be emphasized to ensure volunteers have a complete understanding of the policy and procedures. Bruce Smargiasso, Tanya Ray Corrective Action Plan: ? The Housing Authority of the City of Pittsburg encountered many challenges post COVID operations. After 15 months of suspended inspections, the Housing Authority utilized a third-party vendor to conduct HQS inspections as well as send all inspection notices in a very short, compacted time period. In addition, two staff members were absent for several months near the end of this period making follow-up reporting difficult. ? As a result, HA Management & Staff have reinstituted a tracking log for 24-hour deficiencies and informed all Inspectors to notify the Housing Authority (HA) immediately. The HA has provided inspectors batteries for smoke detectors so 24-hour deficiencies can be more accurately tracked. ? In addition, the Housing Authority plans to implement a Request for Proposals (if needed under the HA Purchasing Policy) to execute a contract with a third-party vendor that will complete all aspects of HUD?s required inspection process. Anticipated Completion Date: ? The Housing Authority Manager has requested a quote for Inspection Services and will pursue an RFP if required. This process is anticipated to be executed within 90-120 days.

Corrective Action Plan (CAP) The management of the Housing Authority of the City of West Point (WPHA) has worked to establish and maintain effective internal controls over reporting while maintaining the WPHA during the COVID Pandemic. Executive Director Mauresha Harris is responsible for the implementation of the corrective action plan. CAP developed to resolve audit finding: 2022-002 ? Federal Audit Deadlines not met. 1. The Executive Director shall keep a list of federal audit deadlines that are applicable to the WPHA in her office to reference to throughout the fiscal year. 2. Copies of these federal audit deadlines will be provided to each member of the WPHA?s board of commissioners. 3. The WPHA?s fiscal year end document will be provided to the WPHA?s fee accountant and auditor within a 40-day period subsequent to the WPHA?s fiscal year end.

Further, the Board of Commissioners is a volunteer oversight board and not a managing board and does not have the time or expertise to provide the necessary services to correct the internal control deficiencies noted. The Board has reviewed the issue and determined that there are no additional procedures which can be reasonably done to eliminate the deficiencies and accepts them.

The PHA must do the following: As a condition of admission or continued occupancy, require the tenant and other family member to provide necessary information, documentation, and releases for the PHA to verify income eligibility (24 CFR sections 5.230, 5.609, and 982.516). These files are required to be maintained and available for examination at the time of audit. Condition: Based upon inspection of the Authority?s files and on discussion with management, there were documents that were unavailable for examination at the time of audit. Context: There are approximately 2,313 units. Housing Quality Standards Non Compliance Material to the Financial Statements: No Significant Deficiency in Internal Control over Compliance for Special Tests and Provisions Finding 2022-001 (continued): Criteria: Housing Quality Standards Inspections. The PHA must inspect the unit leased to a family at least annually to determine if the unit meets the Housing Quality Standards (HQS) and the PHA must conduct quality control re-inspections. The PHA must prepare a unit inspection report (24 CFR sections 982.158(d) and 982.405(b)). For units that fail inspection the PHA must correct all life threatening HQS deficiencies within 24 hours and all other deficiencies within 30 days. Condition: Based upon inspection of the Authority?s files and on discussions with management, the Authority did not properly abate two (2) out of thirty-one (31) annual failed inspections selected for testing. Recommendation: We recommend the Authority design and implement internal control procedures that will assure compliance with the Uniform Guidance and the compliance supplement. Authority Response: MHA Assistant Program Manager will hold Bi-Weekly inspection meetings with the contractor to discuss compliance with inspection policies and procedures, to confirm that software is running properly, and to confirm that inspections-related payment holds and abatements/inspection cures comply with MHA?s policies. The contractor is to notify MHA immediately if any non-compliance inspections-related payment hold or non-abatement occurs. Response: The Reserve for Replacement required deposits were not made in each current month throughout the year due to cash flow issues and the 5 month delay is receiving an approve budget and contract renewal. However, all required deposits were made prior to 12/31/2022. The project has complied with the replacement Reserve requirement as mentioned in HUD Handbook 4350.1 REV-1, Chapter 4-2. Though, the project was late in depositing payments this is not a significant violation of the HUD Handbook 4350.1 REV-1, Chapter 4-2 and the Regulatory Agreement. The requirement to fund and maintain the Replacement Reserve account was accomplished. The project must not be penalized for a delay in making a monthly payment. The defect was cured in a timely manner. Also, this is not a material weakness to raise it to the level of a reportable condition. 2022-1 ? Reserve for Replacement Deposit Not Made Timely Condition: The Project did not make the required deposit into the bank on a monthly basis. Response: The January 2022 Reserve for Replacement required deposit was not made in January. That deposit was made in February along with all required monthly deposits for the remaining of the year. The project has complied with the replacement Reserve requirement as mentioned in HUD Handbook 4350.1 REV-1, Chapter 4-2. Though, the project was late in depositing the January payment this is not a significant violation of the HUD Handbook 4350.1 REV-1, Chapter 4-2 and the Regulatory Agreement. The requirement to fund and maintain the Replacement Reserve account was accomplished. The project must not be penalized for a 30-day delay in making a monthly payment. The defect was cured in a timely manner. Also, this is not a material weakness to raise it to the level of a reportable condition. We do not agree that this is as an instance of material weakness to be elevated to a reportable condition.

Corrective Action Plan For the year ended December 31, 2022 U.S. Department of Housing and Urban Development: The Lehigh County Housing Authority respectfully submits the following corrective action plan for the year ended December 31, 2022. Auditor: Novogradac & Company, LLP Certified Public Accountants 1144 Hooper Avenue, Suite 203 Toms River, New Jersey 08753 The findings from the December 31, 2022 schedule of findings and responses are discussed below. The findings are numbered consistently with the numbers assigned in the schedule. Financial Statement Findings There were no findings relating to the financial statements which are required to be reported in accordance with Government Auditing Standards. Federal Award Findings and Questioned Costs Finding 2022-001: Federal Agency: U.S. Department of Housing and Urban Development Federal Program Titles: Section 8 Housing Choice Vouchers Program Federal Catalog Numbers: 14.871 Noncompliance ? N. Special Tests and Provisions ? Housing Quality Standards Non Compliance Material to the Financial Statements: Yes Material Weakness in Internal Control over Compliance for Special Tests and Provisions Criteria: Housing Quality Standards Inspections. The PHA must inspect the unit leased to a family at least biennially to determine if the unit meets the Housing Quality Standards (HQS) and the PHA must conduct quality control re-inspections. The PHA must prepare a unit inspection report (24 CFR sections 982.158(d) and 982.405(b)). Condition: Based upon inspection of the Authority?s files and on discussion with management, there were units that were not reinspected within the biennial reinspection period of two (2) years. Finding 2022-001: (continued) Context: There are approximately 1,043 Section 8 Housing Choice Vouchers units. Of a sample size of twenty-three (23) tenant files, five (5) biennial inspections were not completed in a timely manner. Our sample size is statistically valid. Known Questioned Costs: $42,870 Cause: There is a material weakness in internal controls over the compliance for the special tests and provisions type of compliance related to HQS inspections. The Authority has not properly performed HQS inspections in compliance with program requirements following the expiration of HUD waivers as a result of a software error. Effect: The Section 8 Housing Choice Vouchers Program is in material non-compliance with the special tests and provisions type of compliance related to HQS inspections. Recommendation: We recommend the Authority design and implement a corrective action plan that will assure compliance with the Uniform Guidance and the compliance supplement. Authority Response: The Authority accepts the recommendation of the auditor, and will make the several changes to its inspection process to ensure enforcement of Housing Quality Standards (or any subsequent replacement). Views of responsible officials and planned corrective action: Helen Khouli, HCV Program Coordinator, is responsible for implementing this corrective action by December 31, 2023.

Timely Submission of Required Reporting Packages Federal Assistance Listing Number Name of Federal Program 14.129 Mortgage Insurance Nursing Homes, Intermediate Care Facilities, Board and Care Homes and Assisted Living Facilities Criteria The Home is required to file its Owner Certified Real Estate Assessment Center (REAC) financial statements by March 31, 2023, in accordance with U.S. Department of Housing and Urban Development (HUD) regulations. Condition The Home?s Certified REAC financial statement submission due March 31, 2023, was not filed timely. Questioned Costs None Context While performing the audit, we noted that the March 31, 2023 Owner?s Certification submission to REAC was not filed timely. Effect The failure to submit the Owner?s Certification on a timely basis caused the Home to be noncompliant with the reporting requirements of HUD. Recommendation We recommend that the Home ensure the filing of its HUD report is performed in accordance with HUD reporting requirements. Management's Response Management acknowledges that owner certified financial data is required to be submitted through HUD?s REAL ESTATE ASSESSMENT online system by March 31 of each year for the preceding calendar year. To ensure that this deadline is adhered to each year going forward the CFO or designee will create an aggressive closing schedule so that accurate financial information is available by February 15th of each year from which to create the owner certified submission.

Comments on the Finding and Recommendation We concur with the auditors finding as follows: In connection with out lease file review, we noted the following deficiencies: The enterprise income verification form in the tenant?s file for 2 out of 15 tenants tested did not have documentation in their lease file that their income was verified. The procedures applied to a sample of 1 out of 2 tenants tested did not have move out inspections in their lease files. The procedures applied to a sample of 1 out of 15 tenants tested did not have a signed HUD Form 50059 in their lease files. b. Action(s) Taken or Planned on the Finding Management has engaged Onesite Realpage Compliance Monitoring to review all files going forward to ensure compliance with EIV.
