Further, under 2 CFR 200.320(c), there are specific circumstances in which noncompetitive procurement can be used. Noncompetitive procurement can only be awarded if one or more of the following circumstances apply: 1) The acquisition of property or services, the aggregate dollar amount of which does not exceed the micropurchase threshold; 2) The item is available only from a single source; 3) The public exigency or emergency for the requirement will not permit a delay resulting from publicizing a competitive solicitation; 4) The federal awarding agency or pass through entity expressly authorizes a noncompetitive procurement in response to a written request from the non federal entity; or 5) After solicitation of a number of sources, competition is determined inadequate. In addition, under 2 CFR 200.318(h), the non federal entity must award contracts only to responsible contractors possessing the ability to perform successfully under the terms and conditions of a proposed procurement. Consideration will be given to such matters as contractor integrity, compliance with public policy, record of past performance, and financial and technical resources. Further, the regulations under 2 CFR Part 180 restrict awards, subawards, and contracts with certain parties that are debarred, suspended, or otherwise excluded from or ineligible for participation in federal assistance programs or activities. Condition The Council did not have adequate controls in place to ensure compliance with the applicable procurement and suspension and debarment standards and its own internal procurement policy. Questioned Costs $125,000 Identification of How Questioned Costs Were Computed The questioned costs represent contracts entered into under noncompetitive procurement methods with opportunities for full and open competition and activity related to those contracts reported on the schedule of expenditures of federal awards for the period under audit. Context - During procurement testing, we noted two contracts over the Council's formal procurement threshold of $50,000 where the Council procured these services using noncompetitive methods. However, opportunities existed to procure services with full and open competition. Additionally, we noted six instances for which a check for suspension and debarment was not performed. The Council did perform the suspension and debarment check after we identified the noncompliance and noted that none of the six contractors were suspended or debarred; therefore, noting no questioned costs. Cause and Effect - Per review of the Council's financial management manual, we noted procurement guidelines for primary use vendors (those procured using noncompetitive methods) wer not clearly defined). Additionally, the Council's procurement guidelines are silent on services provided on an extended contract. Further, we noted a lack of controls surrounding chcks for suspension and debarment on primary use vendors. The lack of clarity within the Council's policies and procedures to align with procurement, suspension, and debarment resulted in the noncompliance. Recommendation - We recommend the Council update its policies and procedures to align with procurement, suspension, and debarment requirements under the Uniform Guidance. Views of Responsible Officials and Corrective Action Plan - Management has revised the financial management manual with an updated procurement policy in accordance with federal regulations. The Council has developed detailed procedures and required documentation for staff to ensure compliance. Mandatory training will be provided to staff that engage in purchasing activities.

Repeat Finding This is a repeat finding from the immediately prior audit report. The prior audit finding number was 2021-002. Condition and Context The School Corporation had not properly designed or implemented a system of internal controls that would likely be effective in preventing, or detecting and correcting, noncompliance for small purchases. Federal regulations allow for informal procurement methods when the value of the procurement for property or services does not exceed the simplified acquisition threshold, which is set at $250,000 unless a lower, more restrictive threshold is set by a non-federal entity. As Indiana Code has set a more restrictive threshold of $150,000, informal procurement methods are permitted when the value of the procurement does not exceed $150,000. This informal process allows for methods other than the formal bid process. The informal process is divided between two methods based on thresholds. Micro-purchases, typically for those purchases $10,000 or under, and small purchase procedures for those purchases above the micro-purchase threshold, but below the simplified acquisition threshold. Micro-purchases may be awarded without soliciting competitive price rate quotations. If small purchase procedures are used, then price or rate quotations must be obtained from an adequate number of qualified sources. There was no documented oversight, review, or approval process in place at the School Corporation to ensure proper procedures were followed and price or rate quotations were obtained from an adequate number of qualified sources for small purchases. The School Corporation did not obtain price or rate quotes for five of the five vendors tested. A total of $82,230 was spent with the five vendors. Documentation detailing the history of procurement, which must include the reason for the procurement method used, was not available for audit. The lack of internal controls and noncompliance were systemic issues throughout the audit period. Criteria Indiana Code 4-13.6-5-2 states: "(a) Except as provided by this chapter and IC 16-33-4-10, if the estimated cost of a public works project is at least one hundred fifty thousand dollars ($150,000), the division shall award a contract for the project based on competitive bids. Condition: During our testing of single audit disbursements, we identified a vendor which would meet the requirement of verifying that the vendor was not suspended or debarred or otherwise excluded from receiving the contract which was funded through Federal dollars. The vendor received more than $25,000 in payments from the District from Federal grant sources. The vendor is not currently suspended or debarred from receiving Federal contracts; however, the District did not have proper internal controls in place to verify this prior to the purchase. The District did make improvement in this area for all new work during the year. However, these projects were completed in the year under audit before the District became aware of the requirements above and could not retroactively cure the errors. Cause: District personnel did not verify that vendors which meet the $25,000 thresholds are not suspended, debarred, or otherwise excluded from participating in contracts funded through Federal awards due to a misunderstanding of staff personnel regarding this requirement. Effect: The District is not in compliance with Federal regulations related to the grant and could put funding in jeopardy or require the District to reimburse the program for improper grant distributions. Auditor’s Recommendation: We recommend the District establish a policy and implement procedures regarding large purchases related to Federal grants to insure that no vendors who are suspended, debarred, or otherwise excluded from participating in transactions funded through Federal grants are used. As identified above, there are several methods in which the District can verify vendors are not suspended or debarred. The District may have the vendor provide an annual certification that it is not currently suspended, debarred, or otherwise prevented from receiving Federal dollars. In other occasions in which a single purchase is going to be made, the purchasing procedures should include looking up the vendor on the GSA website, printing a copy of the verification, and placing it in the file with the purchase order. The District has options, and it should establish what method is the least intrusive but also effective in complying with the requirements of the Uniform Grant Guidance. Responsible Official’s Plan:  Specific corrective action plan for finding: The Grants Finance Department, Federal Grants Department, Operations Department along with the Purchasing Department will review Vendors that are issued requisitions at each approval level to assist in catching $25K or more for Suspension and Debarment. As the grant agreements were between the Indiana Department of Education and each member school, the School Corporation was responsible for ensuring and providing oversight of the Cooperative. However, there was inadequate oversight performed by the School Corporation in order to ensure compliance with the Procurement and Suspension and Debarment compliance requirement. The Cooperative did not have adequate procedures in place to ensure that the requirements for small purchases were met for each applicable procured good or service or to ensure that vendors were not suspended or debarred prior to entering into a covered transaction. Procurement Federal regulations allow for informal procurement methods when the value of the procurement for goods or services does not exceed the simplified acquisition threshold, which is customarily set at $250,000. However, Indiana Code 5-22-8 has a more restrictive threshold of $150,000 or less for when small purchase procedures may be used. This informal process allows for methods other than the formal bid process. The informal process is divided between two methods based on thresholds. Micro-purchases, typically for those purchases $10,000 or under, and small purchase procedures for those purchases above the micro-purchase threshold, but below the simplified acquisition threshold. This verification may be accomplished by (1) checking the System for Award Management (SAM) Exclusions maintained by the General Services Administration, (2) collecting a certification from the entity, or (3) adding a clause or condition to the covered transaction with that entity (2 CFR section 180.300). Condition Through our testing of 88 procurement transactions greater than the micro-purchase threshold across four campuses and 83 transactions related to suspension and debarment across four campuses, we noted the following at one campus: • For four out of 25 procurement selections totaling $964,259, the source selection and price reasonableness justification form was not completed and as such, we were unable to obtain documentation for how these vendors were selected. • Seven SAM.gov checks of the 25 selected for testing, totaling $900,152, were not dated and as such, we were unable to confirm these checks were completed in a timely manner. For two selections, totaling $47,521, we were unable to obtain support that these vendors were either checked for suspension and debarment against SAM.gov or if the vendor was not listed on SAM.gov, evidence that the purchasing staff issued the Debarment Certification to the vendor to complete prior to the posting of the purchase order, as required by campus policy. Additionally, one Debarment and Certification form was dated after the posting of the purchase order on a transaction totaling $249,850. This is a repeat finding of 2021-003, which continued to remain open during FY2022. Cause The buyers executing these transactions did not provide the required support when executing these transactions due to lack of understanding of what is required for a federal purchase. Additionally, there are no additional levels of reviews required, such that missing documentation would be identified prior to executing federal purchases. Effect The University may not select a vendor in the most efficient manner without following proper federal procurement procedures and additionally, they may do business with a vendor that is suspended or debarred if checks are not performed. Questioned Costs None noted. Recommendation We recommend the campus provide additional training in this area and determine if there is a more effective way to flag federal transactions for buyers and when flagged, guidance is readily made available as to what documentation is required prior to executing the transaction. In addition, small purchase procedures per 2 CFR 200.320(a)(2)(i) for acquisitions between the micro-purchase threshold (currently $10,000) and the simplified acquisition threshold (current $250,000), price or rate quotations must be obtained from an adequate number of qualified sources as determined appropriate. Per 24 PS 8.807.1, there should be three quotes that are either written or well documented. CAUSE: School District personnel directly responsible for the oversight and execution of the copier contract interpreted that the requirements specified by 2 CFR 200.318(i) and 2 CFR 200.320(a)(2)(i), would be met through the cooperative purchasing, however the District appears to not have received and maintained all of the specific history of procurement documents internally, as referenced under the criteria section, to support this compliance. In addition, the District did not 1) maintain documentation to substantiate that an adequate number of price quotations were solicited for professional emotional support services, and 2) did not properly document that the education material was from a sole source provider, and accordingly competitive procurement procedures would not apply. EFFECT: The Northern Cambria School District did not comply with the requirements of 2 CFR 200.318(i) and 2 CFR 200.320(a)(2)(i) of the Uniform Guidance, regarding maintaining records sufficient to detail the history of procurement for the copiers, and to document instances where there is a sole source provider such as would be required for the educational materials. In addition, the District did not comply with 24 PS 8.807.1 regarding maintaining documentation to substantiate that an adequate number of price quotations were solicited for professional emotional support services. QUESTIONED COST: $134,156 (Advanced Office Systems-$26,851) (Acorns to Oaks Consulting, LLC-$33,890) (McGraw-Hill Education-$73,415) RECOMMENDATION: I am recommending that the management of the School District review and update as necessary its procurement policies to ensure retention of the appropriate procurement documentation, in all instances, including such instances whereby the District is using a contract vehicle from a cooperative purchase network so as to comply with all applicable sections of the Uniform Guidance, specifically Section 2 CFR 200.318(i) and 2 CFR.320(a)(2)(i) of the Uniform Guidance. In addition, it is recommended that the District document its attempts to obtain an adequate number of price or rate quotations as specified by 24 PS 8.807.1 over the $10,000 expenditure threshold, as well as document instances whereby the District is using a sole source provider and accordingly competitive procurement procedures would not apply.
