Findings and Questioned Costs Related to Federal Awards Finding Number: 2024‐001 Repeat Finding: No Program Name/Assistance Listing Title: Coronavirus State and Local Fiscal Recovery Funds Assistance Listing Number: 21.027 Federal Agency: U.S. Department of Treasury Federal Award Number: ERMT‐21‐2016 Pass‐Through Agency: Arizona Governor’s Office Questioned Costs: N/A Type of Finding: Noncompliance, Significant Deficiency Compliance Requirement: Procurement and Suspension and Debarment Criteria Non‐federal entities other than states, including those operating federal programs as subrecipients of states, must follow the procurement standards set out at 2 CFR §§200.318 through 200.326. Subrecipients must use their own documented procurement procedures, which reflect applicable State and local laws and regulations, provided that the procurements conform to applicable federal statutes and the procurement requirements identified in 2 CFR part 200. Condition The District did not follow Federal, State, and Board policies and regulations governing procurement. Cause The District’s review procedures over each transaction did not operate as designed. Effect The District was not in compliance with Federal, State, and Board policies and regulations governing procurement. Context The District procured a multi‐year professional development support services contract in the amount of $111,200 using quotations rather than issuing a formal procurement. The sample was not intended to be, and was not, a statistically valid sample. Recommendation Approvers of requisitions should ensure multi‐year purchases exceeding the formal procurement threshold are appropriately procured in accordance with Federal, State and Board policies and regulations. Condition: During our testing we discovered one contract which lacked documentation to demonstrate that competitive bids were obtained, contractor selection or rejection, and determination as to whom the contract was awarded to. Context: Error was isolated to one contract tested. Questioned Costs: This resulted in a contract of $997,040 being awarded without competitive bidding documentation. Cause: Change in key management. Effect: The District could potentially award contracts without doing due diligence. Recommendation: We recommend that the District comply with 2 CFR, section 200.318-322, which requires that an LEA maintain the documented procedures for procurement transactions under a federal award. Views of Responsible Officials: We posted a job walk and had one bidder. In the future we will post for a longer period of time and if needed repost for a second job walk. We will note each company that attends and if they did or did not chose to bid the job. They must use their own documented procedures, which reflect applicable state and local laws and regulations, provided that the procurement standards conform to the applicable federal statutes and the procurement requirements identified in 2 CFR part 200. Condition: The Organization has a procurement policy in place; however, the Organization is not consistently following the procurement policy. During the period of the contracts with these provisions, the Organization did not have a control structure in place to monitor compliance with procurement requirements. Consequently, for one (1) of six (2) contracts tested, the procurement policy was not followed and no documentation to reflect compliance with Uniform Guidance requirements related to procurement could be provided. Cause: The procurement policy retained by the Organization has not been updated to conform with the Organization’s current operations. Effect or potential effect: The Organization could become noncompliant with the requirements of the Uniform Guidance, resulting in future findings and questioned costs related to dollar amounts being expended to vendors. Additionally, the Organization could become ineligible to receive funds from federal entities or may have to issue refunds to federal entities. Questioned costs: None. Context: Our sample was not intended to be statistically valid. Recommendation: The Organization updated its procurement policy to reflect current operations, but did not go back and document procurement compliance against existing vendors. The Organization should review the current procurement operations in conjunction with the review of the procurement policies to ensure that all practices and policies conform to the standards promulgated by the CFR.
