Finding Text

FINDING 2025-201 The Commission did not include administrative costs in required reports for the Federal Funding Accountability and Transparency Act (FFATA). Additionally, the Commission did not have any documentation to support adequate internal controls over FFATA reporting. Type of Finding: Material Weakness, Material Noncompliance Assistance Listing Title: Special Programs for the Aging – Title III, Part B—Grants for Supportive Services and Senior Centers; Special Programs for the Aging, Title III, Part C, Nutrition Services Assistance Listing Number: 93.044; 93.045 Federal Award Number: 2401IDOASS; 2401IDOACM; 2401IDOAHD Program Year: October 1, 2023 – September 30, 2026 Federal Agency: Department of Health and Human Services Compliance Requirement: Reporting Questioned Costs: None Criteria: The U.S. Code of Federal Regulations (CFR) Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards (2 CFR 200.303) states that non-federal entities must establish and maintain effective internal control over the federal award that provides reasonable assurance that the non-federal entity is managing the federal award in compliance with federal statutes, regulations, and the terms and conditions of the federal award. The Committee of Sponsoring Organizations of the Treadway Commission (COSO) published the Internal Control Integrated Framework, which provides a basis for organizations to design internal control procedures to ensure reliable financial reporting, effective and efficient operations, and compliance with applicable laws and regulations. Components of this framework include control activities and information and communication. Under the requirements of the FFATA, Pub. L. No. 109-282, as amended by Section 6202 of Pub. L. No. 110-252, and codified in 2 CFR Part 170, recipients (i.e., direct recipients) of grants or cooperative agreements are required to report first-tier subawards of $30,000 or more to the federal government no later than the final day of the month following an actionable activity. Condition: The FFATA was developed to provide better transparency over management of federal grants and contracts. Reporting is required on allocations of $30,000 through the federal website, SAM.gov. The Commission is the primary recipient of the Aging Cluster Grant program (Assistance Listings 93.044, 93.045, 93.053) and required to comply with FFATA reporting as part of the terms and conditions related to receiving this grant. The Commission’s personnel indicated that a process is in place where the Operations Manager reviews and approves FFATA submissions; however, the review is not properly documented. Without adequate documentation, we cannot substantiate that the review consistently occurred and operated effectively. Additionally, the Commission did not include administrative costs in the FFATA reports submitted for the fiscal year, despite the Commission issuing amounts to the Area Agencies on Aging (AAAs) in excess of $30,000 dollars for those costs. Admin Allocations represents $720,218 in disbursements to sub-awardees which indicates significant underreporting. Reports Tested Not Reported Late Incorrect Missing Elements 9 0 0 0 0 Amount Tested Amount Not Reported Amount Late Amount Incorrect Amount Missing Elements $3,697,670 $720,218 $0 $0 $0 Cause: Commission personnel were not aware of the FFATA reporting requirements specifically for subawards to include administrative cost distributions and did not implement internal controls to ensure the accurate submission of the FFATA reports. Effect: The FFATA reports are required to be submitted to the federal government, which makes the information available to the public in a searchable database. Incorrect or incomplete FFATA reporting may lead to significant administrative, financial, and reputational consequences. A lack of documented controls over reporting can lead to increased likelihood of inaccurate reporting by the Commission. Recommendation: We recommend that the Commission implement documented internal control procedures for the required FFATA reporting to ensure the completeness of its submissions. We further recommend that the Commission consider improving training procedures to ensure that staff are knowledgeable about the requirements of grants accepted by the Commission. Management’s View: The Commission agrees with this finding. Corrective Action: The Commission acknowledges that the sub-award amounts reported under ALNs 93.044, 93.045, and 93.053 did not include all allocable administrative costs for the sub-recipient tested. We have taken the following corrective actions, all of which were implemented during the audit following identification of this issue: 1. Revised FFATA Sub-Award Reports -The Commission revised the affected FFATA sub-award reports in SAM.gov to include the administrative costs allocable to each of the three tested ALNs for the sub-recipient identified in the finding. The revised reports were provided to LSO for review on 06/18/2026. 2. Revised FFATA Reporting Policy Implemented: The Commission developed a documented policy governing FFATA sub-award data entry, review, and approval. The policy establishes the following: • The Financial Technician is responsible for entering all FFATA sub-award data and must confirm that reported amounts include direct program costs and administrative costs allocable to the sub-award. • The Financial Specialist Senior is required to review all FFATA entries for accuracy and completeness. The Financial Specialist will document their review. This step is the specific control that was absent during the audit period. • Documentation of each review and approval must be retained. Auditor’s Concluding Remarks: We thank the Commission for its cooperation and assistance throughout the audit.
