Eligibility U.S. Department of Health and Human Services Community Service Block Grant – ALN #93.569Criterion:Per 2 CFR 200.303, a non-federal entity must establish and maintain effective internal control over the Federal award that provides reasonable assurance that the non-federal entity is managing the Federal award in compliance with Federal statutes, regulations, and terms and conditions of the Federal Award.The Organization is responsible for ensuring that a participant is eligible to receive services under the CSBG program. The Organization requires management review of participant files to ensure that eligibility procedures have been performed during the intake process to ensure each participant is eligible. Condition:During our review of 25 eligible participant files, 18 out of 25 participant files did not contain evidence of management review prior to CSBG program benefits being provided.Cause and Effect:Management has a process in place to ensure that effective internal controls related to CSBG Eligibility requirements are properly implemented. The internal controls the Organization has in place for the CSBG eligibility determination process were not utilized. Therefore, intake forms and other relevant documentation within CSBG participant files were not properly approved by management in accordance with 2 CFR part 200, subpart D. Recommendation: We recommend that management enhance the design of its control activities to ensure that CSBG participant files are adequately maintained, and strengthen controls surrounding management review of participant files during the intake process to ensure individuals receiving services are eligible for benefits.View of Responsible Officials:The Organization agrees with this finding and has developed a corrective action plan to address.

Finding Title: Lack of Documented Evidence of Review Process for Reports Submitted to HRSA Federal Agency: U.S. Department of Health and Human Services (HHS) - Health Resources and Services Administration (HRSA) Federal Program: COVID-19 Provider Relief Fund Assistance Listing Number: 93.498 Award Year: January 1, 2022 to June 30, 2022 Compliance Requirement: Reporting Questioned Costs: N/A Type of Finding: A Significant Deficiency in Internal Control Over Compliance Criteria: The Uniform Guidance Compliance Supplement (2 CFR § 200.303) requires agencies to establish and maintain effective internal controls over federal awards to ensure compliance with statutes, regulations, and the terms of federal awards. Documented evidence of controls, such as review and approval processes, is critical for demonstrating compliance with federal reporting requirements. Condition: During testing of compliance controls, we noted that the Agency failed to provide documented evidence supporting the review and approval process for reports submitted to the Health Resources and Services Administration (HRSA). Management could not produce traceable records or evidence demonstrating that reports were reviewed for accuracy and completeness prior to submission. Cause: The deficiency arose from a lack of formalized processes and procedures requiring the documentation of review and approval steps for federal grant reporting. Contributing factors included inadequate oversight and insufficient training on federal grant compliance requirements. Effect: The absence of documented evidence of a review process increases the risk of errors or omissions in reports submitted to HRSA. This deficiency could result in non-compliance with federal reporting requirements, potentially jeopardizing the Agency's ability to demonstrate appropriate use of Provider Relief Fund (PRF) grant funds. Context: The Provider Relief Fund (PRF), established under the CARES Act, supports healthcare providers affected by the COVID-19 pandemic. Recipients of PRF funds are required to submit detailed reports to HRSA, ensuring accountability and transparency in the allocation of federal resources. A documented review process is essential to ensure that submitted reports accurately reflect the use of grant funds in compliance with federal requirements. Recommendation: We recommend that the Agency: - Develop and implement formalized procedures for the review and approval of federal grant reports before submission to HRSA. - Maintain traceable audit evidence, such as documented review checklists, signed approvals, and timestamps, to demonstrate compliance with federal reporting requirements. - Provide training to staff involved in the preparation and review of federal grant reports to ensure understanding of compliance requirements and the importance of documentation.

Department of Health and Human Services Federal Assistance Listing #93.498 COVID-19 Provider Relief Fund and American Rescue Plan (ARP) Rural Distribution Applicable Federal Award Number and Year - Period 2 TIN #736060815 Reporting Material Weakness in Internal Control Over Compliance and Material Noncompliance Criteria: CFR 200.303(a) establishes that the auditee must establish and maintain effective internal control over the federal award that provides assurance that the entity is managing the federal award in compliance with federal statutes, regulations, and conditions of the federal award. Condition: The Authority selected Option 1, as defined by HRSA, to calculate lost revenue. This option consists of reporting actual revenues from relevant quarters in the period of availability with the system calculating the lost revenues because of declines. The fiscal year 2021 single audit identified unallowable expenses totaling $263,861. The Company utilized excess lost revenues at the time to cover this difference. To capture the use of these lost revenues from Period 1, the Authority should have used Option 3, as defined by HRSA, to calculate and report lost revenues. Within that calculation, lost revenues could then be reduced by the $263,861. Cause: The Authority's Period 2 report to HRSA was filed prior to the completion of the 2021 single audit and identification of these unallowable expenses. Effect: The reporting to HRSA for Period 2 was considered incorrect. The Authority did not reduce lost revenues by amounts used in the prior period on unallowable expenses. While the effects of the report errors did not result in unallowable lost revenues during Period 2, errors to amounts reported for lost revenues could result in unallowable costs. Questioned Costs: None reported. Context/Sampling: All key line items on the Period 2 report to HRSA were tested. Repeat Finding from Prior Years: No. Recommendation: We recommend the Authority report on lost revenues for any future reporting to HRSA utilizing Option 3 in order to show the use of the unallowable expenses from Period 1. Views of Responsible Officials: Management agrees with the finding.

Condition: The Authority tracked patient care revenues internally within a spreadsheet. The calculations of revenue by payor within the spreadsheet and included on the Period 2 report to HRSA, which were utilized to calculate lost revenues, contained errors. Cause: The Authority’s internal controls in place to review the lost revenue calculation prior to finalization of the HRSA Period 2 submission did not identify errors in the calculation. Additionally, the review and approval of the report submitted to the Health Resources and Services Administration (HRSA) for Period 2 was not performed by someone other than the preparer, resulting in the errors in patient revenue by payor not being detected. Effect: The reporting to HRSA for Period 2 contained errors in patient care revenue by payor, which are considered key line items in that report. While the result of the errors did not impact lost revenues calculated, there is a potential for similar errors to impact the lost revenue calculation. In addition, the lack of review of the report increases the possibility that ineligible expenditures may be claimed under the program and the report may not be accurately completed. Questioned Costs: None. While there were errors in patient care revenues by payors for certain key line items, the errors did not impact the calculation of lost revenues. Context: All key line items related to the calculation of lost revenues based on an Option 1 calculation, as defined by HRSA, were tested. Errors were identified in 8 key line items specifically related to patient care revenues by payor for two separate quarters. The errors did not impact the total revenue reported for any quarter. Repeat Finding from Prior Years: No Recommendation: We recommend management implement policies and procedures to ensure a complete revenue of supporting documentation and any reporting to a federal agency prior to submission by an individual separate from the preparer. Furthermore, while performing a test over the reporting requirement, we noted the following: • Interim report was not submitted. • Variances between expenditures reported on the quarterly reports and the County’s expenditure data: o Quarterly reports during the period of March through December 2021 expenditure amounts were more than County’s the expenditure data by $124,984. o Quarterly report Q1 2022 expenditure amount was more than the County’s expenditure data by $1,140,410. o Quarterly report Q2 2022 expenditure amount was less than the County’s expenditure data by $39,146. The following deficiencies were noted: • The BOCC is aware there are compliance supplement requirements; however, they are not aware of the specifics of the requirements and there is no one assigned to keep up with the compliance requirements. • There is no evidence federal expenditures are presented to the BOCC in an open meeting prior to submission to the awarding agency. • The risks of incorrect financial reporting, resulting from fraud or error, for the Schedule of Expenditures of Federal Awards (SEFA) are not addressed verbally or in written communication. • The County is relying on the Clerk and Treasurer to ensure the accuracy of the SEFA. • The individual submitting reports to the U.S. Department of the Treasury is using credentials assigned to someone else. Cause of Condition: Policies and procedures have not been designed and implemented to ensure the County complies with grant requirements. Effect of Condition: Without an adequate system of county-wide controls, there is greater risk of a breakdown in control activities which could result in unrecorded transactions, undetected errors, misappropriation of funds, and noncompliance with federal grant requirements. Recommendation: OSAI recommends that the County implement a system of internal controls to ensure compliance with grant requirements. Management Response: District 1 County Commissioner: Not by way of excuse, but truly in response, the Federal programs associated with the COVID response were unnecessarily arduous and created confusion at all levels of government. While the monetary response was accepted, the premise of these programs was nothing more than an administrative shell game. From the outset of the response, guidance was termed as “interim”, then “final Interim” and finally, “final” (redundancy intentional). The intent of our national level leadership became more apparent as these programs progressed with each iteration of programming being reliant on returned funds from the previous. Without grandstanding, I will simply say that no entity, regardless of their planning with these programs, will be found as fully compliant. As these programs have a sunset in the near term, I suspect these findings will disappear. District 2 County Commissioner: I was not in office the year audited, but I will work with other elected officials to implement a system of internal controls to ensure compliance with grants requirements. Additionally, GAO Standards – Section 2 – Establishing an Effective Internal Control System – OV2.04 states in part: Components, Principles, and Attributes Control Environment - The foundation for an internal control system. It provides the discipline and structure to help an entity achieve its objectives. Risk Assessment - Assesses the risks facing the entity as it seeks to achieve its objectives. This assessment provides the basis for developing appropriate risk responses. Information and Communication - The quality information management and personnel communicate and use to support the internal control system. Monitoring - Activities management establishes and operates to assess the quality of performance over time and promptly resolve the findings of audits and other reviews. The subrecipient submitted quarterly reports for Quarter 1 and Quarter 2 to the BOCC on August 8, 2022. Cause of Condition: Policies and procedures have not been designed and implemented to ensure federal program expenditures are made in accordance with federal compliance requirements. Effect of Condition: This condition attributed to the noncompliance with grant requirements and could lead to the loss of federal funds to the County. Recommendation: OSAI recommends the County gain an understanding of requirements for this program and implement internal control procedures to ensure compliance with all requirements. Management Response: District 1 County Commissioner: Not by way of excuse, but truly in response, the Federal programs associated with the COVID response were unnecessarily arduous and created confusion at all levels of government. While the monetary response was accepted, the premise of these programs was nothing more than an administrative shell game. From the outset of the response, guidance was termed as “interim”, then “final Interim” and finally, “final” (redundancy intentional). The intent of our national level leadership became more apparent as these programs progressed with each iteration of programming being reliant on returned funds from the previous. Without grandstanding, I will simply say that no entity, regardless of their planning with these programs, will be found as fully compliant. As these programs have a sunset in the near term, I suspect these findings will disappear. District 2 County Commissioner: I was not in office the year audited, but I will work with the other elected officials to Implement a system of internal controls to ensure compliance with grant requirements. District 3 County Commissioner: The elected officials will establish sub-recipient monitoring procedures to remain compliant with all requirements for this type of program. In addition, the rents may not exceed rents currently being charged for comparable units, and the rent paid may not exceed HUD-determined fair market rents. Condition: During our testing, we noted that VSS internal controls surrounding fair market rent did not comply with the program requirements. Context and Questioned Costs: During our testing over the special provision for fair market rent, we noted that VSS did not have an updated fair market calculation for 1 of the 5 tested participants. Additionally, noted that the number in the household decreased and there was not an assessment of the fair market rent allowable for the household size. Cause: Lack of established controls and procedures over the program’s fair market rent requirements. Effect: Possible noncompliance with federal requirements and HUD program requirements. In addition, the rent paid may not exceed rents currently being charged by the same owner for comparable unassisted space. Condition: During our testing, we noted that VSS internal controls surrounding fair market rent did not comply with the program requirements. Additionally, the County failed to present $500,000 in subrecipient expenditures on the SEFA for ALN 21.027 - Coronavirus State and Local Fiscal Recovery Funds. Cause of Condition: Policies and procedures have not been designed and implemented to ensure accurate reporting of expenditures for all federal awards. Effect of Condition: This condition resulted in inaccurate recording of the federal expenditures on the SEFA. Recommendation: OSAI recommends county officials and department heads gain an understanding of federal programs awarded to Rogers County. Internal control procedures should be designed and implemented to ensure accurate reporting of expenditures on the SEFA and to ensure compliance with federal requirements. Management Response: Board of County Commissioners: The Board of County Commissioners is responsible for the overall fiscal concerns of the county. See OKLA. STAT. Title 19, § 345. The Board of County Commissioners, with the cooperation and participation of all elected officials, reviews, develops and implements policies and procedures to create a strong internal control environment. Additionally, the Board of County Commissioners conducts meetings with all elected officials and officers responsible for the receipt and/or expenditure of county funds. These meetings address fiscal matters, including but not limited to, policy discussions and implementation, financial reports, budget oversight, SEFA reporting, and legal compliance. Policies and procedures, combined with fiscal oversight meetings, are intended to: 1) prevent or detect material misstatements in the financial statements; 2) prevent or detect fraud within the county; 3) increase communication between the Board of County Commissioners and those elected officials and officers responsible for the receipt and/or expenditure of public funds; 4) provide oversight over the fiscal concerns of the county; 5) identify and address risks related to financial reporting; 6) ensure the accuracy of Rogers County’s financial statements, Estimate of Needs, and the SEFA; and 7) ensure compliance with all applicable federal and state laws, regulations, and/or codes. The Board of County Commissioners, with the cooperation of all elected officials and officers responsible for the receipt or expenditure of federal funds, will evaluate the processes and procedures currently in place to ensure the accuracy of SEFA reporting and detect potential inaccuracies and/or misstatements. Effect of Condition: This condition could result in noncompliance with grant requirements and could lead to a loss of federal funds to the County. These policies and procedures will be designed to identify requirements for recipients and sub-recipients of grants, ensure accurate equipment and real property management, procurement, recipient and subrecipient monitoring and reporting. Further, policies will ensure a proper understanding of all grant requirements and compliance of the same. To assist in this process, the Board of County Commissioners engaged a third-party administrator to oversee the grant process, including application, eligibility, review, requirements, contracting, recipient tracking and oversight, and documentation and reporting. The Board of County Commissioners will work with the third-party administrator to ensure proper grant administration.
